These Terms of Service (“Terms”) govern your use of the Sandalwood Intelligence Platform (“the Platform”) at sandalwood.growbetterindia.com, operated by Grobet India Agrotech Pvt Ltd, Bangalore, India.

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. About the Platform

The Sandalwood Intelligence Platform is a data and education platform that provides:

  • Scientific plantation design tools based on 35+ years of research data
  • Investment calculators with scenario-based financial projections
  • Crop yield databases with variety-wise data
  • Downloadable investment reports
  • Advisory consultation booking

The Platform is NOT:

  • A financial advisory service licensed by SEBI or any regulatory body
  • A real estate or land brokerage
  • A nursery or tree/seedling seller
  • A guaranteed investment scheme
  • A portfolio management service

2. User Accounts

2.1 Registration

  • You must provide accurate, current, and complete information during registration
  • You are responsible for maintaining the confidentiality of your login credentials
  • You must be at least 18 years old to create an account
  • One account per individual. Shared or corporate accounts require Enterprise tier.

2.2 Account Tiers

  • Explorer (Free): Limited access to platform features as described on the pricing page
  • Grower (Standard): Full plantation designer access with PDF exports
  • Premium (Investor): Full access including investment calculator, cashflow projections, and investor reports
  • Enterprise: Unlimited access with ESG reporting and API access

2.3 Account Termination

We reserve the right to suspend or terminate accounts that:

  • Violate these Terms
  • Provide false registration information
  • Attempt to scrape, copy, or redistribute platform data
  • Use the Platform for fraudulent purposes

3. Subscription & Payments

3.1 Pricing

  • Subscription prices are displayed on the Platform in INR and USD
  • Prices are subject to change with 30 days' notice to existing subscribers
  • Applicable taxes (GST for India) will be added at checkout

3.2 Payment Processing

  • Indian payments processed through Razorpay
  • International payments processed through Stripe
  • We do not store your payment card or bank details

3.3 Refund Policy

  • Within 7 days of purchase: Full refund if you have not generated any reports or accessed premium data
  • After 7 days: No refunds for subscription fees already paid
  • Enterprise tier: Refund terms as specified in individual agreements
  • To request a refund, email ml@feedbacknfc.com with your account email and reason

3.4 Auto-Renewal

  • Subscriptions auto-renew at the end of each billing period unless cancelled
  • You can cancel auto-renewal from your account settings at any time
  • Cancellation takes effect at the end of the current billing period

4. Intellectual Property

4.1 Our Content

The following are the intellectual property of Grobet India Agrotech Pvt Ltd and Indian Sandalwood Clusters:

  • All 16 plantation model designs and specifications
  • Scientific crop yield databases (15 crops, 50+ varieties)
  • Soil suitability data and heartwood projection models
  • Financial calculation methodologies
  • Platform design, code, and user interface
  • Educational content, articles, and advisory materials

4.2 Your Rights

  • You may use generated reports and scenarios for your personal investment decision-making
  • You may share your generated PDF reports with your financial advisors, lawyers, and family members
  • You may NOT redistribute, resell, or commercially exploit any platform data, reports, or models
  • You may NOT scrape, crawl, or systematically extract data from the Platform

4.3 User Data

  • You retain ownership of your personal data and inputs
  • You grant us a license to process your inputs for the purpose of generating calculations and reports

5. Disclaimer of Warranties

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Accuracy of projections: Financial projections, ROI calculations, and yield estimates are based on historical data and scientific models. They are NOT guarantees of future performance.
  • Market prices: Heartwood prices (₹6,500–16,500/kg range used in calculations) are based on current market data and historical trends. Actual prices at time of harvest may be higher or lower.
  • Survival rates: Tree survival projections (60%-85%) are estimates. Actual survival depends on soil, climate, management, pest/disease, and other factors beyond our control.
  • Regulatory accuracy: Information about sandalwood cultivation regulations is provided for general guidance. Laws and regulations change. Always consult a qualified lawyer.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are NOT liable for any investment losses, crop failures, regulatory penalties, or financial damages arising from decisions made based on Platform data
  • We are NOT liable for any indirect, incidental, consequential, or punitive damages
  • Our total liability for any claim shall not exceed the amount you paid for your subscription in the 12 months preceding the claim
  • We are NOT responsible for the accuracy of third-party information, market prices, or government policies

7. Advisory Services

  • Consultation bookings through the Platform connect you with the Indian Sandalwood Clusters advisory team
  • Advisory opinions are based on 35+ years of experience but are NOT licensed financial advice
  • Advisory services are subject to separate engagement terms
  • We recommend that all investors conduct independent due diligence and consult qualified professionals (lawyers, chartered accountants, financial advisors) before making investment decisions

8. NRI / International Users

If you are accessing the Platform from outside India:

  • The Platform provides general information about Indian sandalwood cultivation. It does NOT constitute cross-border financial advice.
  • FEMA (Foreign Exchange Management Act) restrictions apply to NRI investment in Indian agricultural land. The Platform provides general guidance but NOT legal counsel.
  • You are solely responsible for compliance with laws in both India and your country of residence.
  • Currency conversions displayed are approximate and based on exchange rates at time of calculation. Actual exchange rates at time of investment/harvest will differ.

9. Prohibited Uses

You agree NOT to:

  • Use the Platform to promote fraudulent sandalwood investment schemes
  • Misrepresent Platform reports as guaranteed investment outcomes to third parties
  • Copy or redistribute our proprietary plantation models or crop databases
  • Use automated tools to scrape or extract Platform data
  • Impersonate other users or provide false information
  • Use the Platform for money laundering or any illegal activity
  • Resell access to the Platform or share subscription credentials

10. Governing Law & Disputes

  • These Terms are governed by the laws of India, specifically the State of Karnataka
  • Any disputes shall be subject to the exclusive jurisdiction of courts in Bangalore, Karnataka
  • Before initiating legal proceedings, both parties agree to attempt resolution through good-faith negotiation for 30 days

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email to registered users at least 15 days before they take effect. Continued use of the Platform after changes take effect constitutes acceptance of the new Terms.
